On June 24, 2024, the Sixth Resolution on the amount of the total value of assets under the Foreign Investment Law was published in the Official Gazette. The National Foreign Investment Commission issued the Resolution determining a new amount of the total value of assets applicable in accordance to Article 9 of the Foreign Investment Law.

Pursuant the provisions of the aforementioned article, a favorable resolution of the Commission is required for foreign investment to participate in the capital stock of Mexican companies in a proportion greater than 49%, provided that the total value of assets exceeds the annual amount determined by the Commission. Previously, the Fifth General Resolution, published on October 27, 2023, established the amount of $24,979,862,979.30. As of the new Sixth Resolution, this value will be adjusted according to the nominal growth of Mexico’s Gross Domestic Product in 2023, which was 8%.

In this regard, the Commission determined an increase of $1,998,389,038.34 thus setting the new amount of the total asset value at $26,978,252,017.64 (twenty-six thousand nine hundred and seventy-eight million two hundred and fifty-two thousand seventeen pesos 00/100 M.N.). This value will remain in force until a new General Resolution is issued.

The resolution will become effective as of the day after its publication in the Official Gazette of the Federation.

The Fifth General Resolution is repealed with the entry into force of the Sixth Resolution.

The notification is made in accordance with Article 27, Section II of the Foreign Investment Law, approved by the Executive Secretary of the National Foreign Investment Commission.
